Allahabad High Court RO/ARO·Concept
Fundamental Rights: Your Constitutional Shield
Part III (Articles 12-35) of the Indian Constitution guarantees six fundamental rights. These are basic human freedoms required for individual and harmonious development. Considered the 'Magna Carta' of India, they are justiciable, allowing citizens to move the court for their enforcement. While not absolute, they can only be restricted on reasonable grounds.
Key points
- Originally 7 rights, the Right to Property was removed by the 44th Amendment Act, 1978.
- The six rights are: Equality, Freedom, Against Exploitation, Freedom of Religion, Cultural & Educational, & Constitutional Remedies.
- Article 32, the "soul of the Constitution," allows direct access to the Supreme Court for enforcement.
- Rights can be suspended during a National Emergency, except for Articles 20 and 21.
- Inspired by the USA's 'Bill of Rights', they protect citizens from arbitrary state power.
