Fundamental Rights: Cornerstone of the Constitution

Part III (Articles 12-35) of the Indian Constitution contains the Fundamental Rights. Inspired by the USA's Bill of Rights, these are justiciable rights essential for the holistic development of individuals. They protect citizens from arbitrary state actions. Originally seven, there are now six categories of Fundamental Rights after the 44th Amendment Act, 1978, removed the Right to Property. They are the bedrock of Indian democracy and individual liberty.

  • Inspired by the US Constitution's Bill of Rights, they are described as the Magna Carta of India.
  • Six Rights: Equality (14-18), Freedom (19-22), Against Exploitation (23-24), Freedom of Religion (25-28), Cultural/Educational (29-30).
  • Article 32 (Right to Constitutional Remedies) is the 'heart and soul' of the Constitution, allowing direct access to the Supreme Court.
  • Rights under Articles 15, 16, 19, 29, & 30 are available only to Indian citizens.
  • Can be suspended during a National Emergency, except for rights guaranteed by Articles 20 and 21.
